Terms of Use of this Website

ADIDAS ORIGINALS "WIN THE WINDOW" CONTEST - TERMS AND CONDITIONS

1. By entering the adidas Win the Wardrobe ('the Contest') you are agreeing to the following terms and conditions.
2. The Contest commences on 27 June 2011 12:01am and concludes on 10 July 11:59pm 2011 ('the Contest Period')
3. To enter the Contest, entrants must purchase any full price adidas Originals item from a participating Red Rat Store and complete the designated entry form to which a valid sales receipt must be attached. The completed entry form must then be placed in the designated entry box. There is no limit to the number of entries per individual over the Contest Period. A separate entry may be made for each separate item purchased by an individual through a given transaction, whereupon a copy of the same sales receipt should be attached to each completed entry form.
4. The Promoter adidas New Zealand 14a George Bourke Drive Mt Wellington Auckland (09)2597700 & Sponsor Red Rat 12 Earl Richardson Ave Wiri Manukau is not responsible for any lost, delayed, illegible, incomplete, misdirected, damaged or destroyed entries.
5. Entry is only open to New Zealand residents only.
6. Employees, officers, and directors (including immediate family members and members of the same household) of the Promoter and Sponsor and their respective affiliates and advertising agencies, media partners for the promotion of the Contest, featured celebrities who agree to promote the Contest, and any other organisations associated with this Contest are not eligible to participate.
7. PRIZES: There are 10 "Win the Wardrobe" prizes ("the Prizes") to be won; one per the following Red Rat stores:
   Head Office, (ONLINE www.redrat.co.nz) 12 Earl Richardson Ave Wiri Manukau. Henderson, 365 Great North Road Henderson Auckland. Otahuhu, 350 Great South Road Otahuhu Auckland. Mangere, Mangere Town Centre Unit 7, 27 The Concourse Mangere Auckland. Papatoetoe, Hunters Plaza Papatoetoe Auckland. Manukau, (Head Office Store) 12 Earl Richardson Ave, Manukau. Papakura, 193A Great South Road Papakura Auckland. Hamilton, The Base 951 Te Rapa Road Hamilton. Rotorua, 1155 Hinemoa Street Rotorua. Hastings, 134 Heretaunga Street Hastings Porirua 1 Serlby Place Porirua.
8. One winner will be drawn for each store. Each entrant is eligible for the Prize at the Red Rat store at which they made the purchase and valid entry.
9. The Prize consists of adidas Originals product up to the value of $500. It excludes any shop fixtures or displaying materials.
10. Prize Total Value across all 10 stores is NZD$5,500. A person may be a prize winner at more than one store, provided they have correctly complied with the terms and conditions.
11. The Promoter and Sponsor reserve the right to substitute the Prizes in whole or in part for something of equal or greater value in the event that any component of the Prize is unavailable. Prizes are not transferable, deferrable, exchangeable (except in accordance with clause 12) or redeemable for product and cannot be taken in cash. The Promoter and Sponsor reserve the right to substitute the Prizes in whole or in part through out the duration of the contest to an equal or greater value.
12. The Prizes will be drawn on the 11/7/11 at 10.00 AM at each of the Red Rat stores participating. Winners will be notified via email, as well as in writing within two working days. Goods must be claimed in store by the winner no longer then 10 working days after being notified. If a prize winner fails to claim their prize within 10 working days of being notified, they will forfeit their prize. In the event, a redraw may take place at the promoter's discretion. The winner may exchange goods in size and colour to an equal or lesser value. It is the responsibility of winners to collect the Prize from the store where their entry was made at their own cost.
13. The Promoter reserves the right to disqualify any entrant submitting an entry which, in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The Promoter's decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the Promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Contest terms and conditions may be disqualified. Subject to any applicable law which cannot be excluded, the Promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the promotion or any prize.
14. The Promoter and Sponsor reserve the right, at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest.
15. INFORMATION PROVIDED. The Promoter will collect personal information about persons who enter this Contest so that those persons can participate in the Contest and the Promoter can administer the Contest. The Promoter will disclose that personal information to organisations associated with this Contest (including the Sponsors). This information will not be disclosed to any other third parties. In entering the contest, the entrant agrees to receive future promotional material from the promoter and /or sponsors. Entrants can contact the Promoter if they wish to access or correct the personal information that the Promoter holds about them.
16. DISCLAIMER. The Promoter and Sponsors reserve the right to withdraw, amend or terminate this Contest at any time without prior notice. The Promoter and Sponsors also reserve the right to cancel this contest at any time because of any printing or other error, or if it either of them suspects or finds evidence of tampering with any part of the Contest. Neither the Promoter nor The Sponsors shall be liable for any errors or negligence that may arise or occur in connection with the Contest. Neither the Promoter nor the Sponsors are liable for injuries, death, damages or losses of any kind resulting from acceptance or use of the Prizes.
17. SUBJECT TO APPLICABLE LAWS. This Contest is subject to all and governed by the laws of New Zealand.

Supply of Goods and Services

Terms of supply
We will endeavour to supply you with the goods or services ordered using this website or our mail / phone order services, but Red Rat will not be liable to any person if we decline to fulfil, or are unable to fulfil, an order. Supply of goods and services to you is made on these Terms only (as we may amend them from time to time). The only circumstance where any variation to these Terms will apply is where Red Rat has expressly agreed in writing to that variation. If there is any conflict with other terms of trade, these Terms will take priority over any other terms of trade.

Product information, images and colours
Product information given on the Red Rat website or in our catalogues and promotional materials is for your guidance but does not afford a guarantee of use. Common sense and discretion are advised in the proper and safe use of all products purchased from us.

Each product purchased is sold subject to its Product Description. Red Rat takes reasonable care to ensure that all details, descriptions and prices of products appearing on our website or in our catalogues and promotional materials are correct. Although we aim to keep these details as up to date as possible, the information, including Product Descriptions, appearing on this website or in a Red Rat catalogue or promotional publication at a particular time may not always reflect the position at the exact moment you place an order.

We cannot guarantee that your monitor’s display of any colour will be accurate. We will endeavour to deliver the corresponding products but do not warrant that the products we deliver to you will be identical to those displayed in the photograph or on your monitor. This also applies to the reproduction of colours and images published in Red Rat catalogues or other promotional materials. Styled images or photographs are used in some cases, in order to help demonstrate how a product may be used or displayed. These extra styling products may or may not be able to be purchased separately from Red Rat.

Prices
The prices displayed on our website are those current at the time we accept your purchase order. Prices displayed in Red Rat catalogues or promotional materials are those current at the time of publication. In all cases, the prices displayed are quoted in NZ dollars and are valid and effective only in New Zealand. Red Rat reserves the right to alter or correct prices without notice if necessary. If this occurs after you have placed an order we will contact you prior to processing your order to ascertain whether you still wish to purchase the affected products.

Prices for goods and services on this website are usually displayed inclusive of goods and services tax ("GST"). However, where corporate or bulk prices are displayed (such as on the “corporate services” pages of the site) these are exclusive of GST.

Gift wrap and gift message services
Where a choice of gift wrap is provided, we will endeavour to provide your choice of design. However, we reserve the right to substitute an alternative wrap where your choice (or the particular designs featured on the website or in Red Rat catalogues or promotional materials from time to time) is unavailable for any reason.

You may request a gift message be sent with your purchase of a gift card or product, when it is delivered directly to your chosen recipient. Red Rat may, at its discretion, remove from any message any content that we consider to be defamatory, obscene, pornographic, indecent, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive, inflammatory or otherwise objectionable.

The Red Rat gift message service is provided free on request with purchases made at retail prices.

Delivery Policy
Delivery fees will be calculated on this website after you have entered in your delivery address, before your enter your payment details. In Red Rat catalogues, the applicable fees are published on the mail-order form. For telephone orders, they will be quoted at the time you place your order. Red Rat delivers throughout New Zealand; however in some remote or isolated areas an additional delivery charge and delivery time may be required. Should your order incur an additional charge, we will advise you prior to processing your order. We do not deliver outside of New Zealand, but we are able to process orders from overseas delivered to a New Zealand address. In some cases an additional delivery fee may be required for extra large or heavy items and we will contact you before we continue with your order.

We will endeavour to deliver your purchase on the agreed delivery dates but we will not be liable for late delivery. Late delivery does not entitle you to cancel any order or part order. Delivery will be deemed to have been made when the goods arrive at the delivery point agreed with you. Delivery may be by installments if all the products are not available at the time of shipping.

Risk and Ownership
Risk in products purchased from us will pass to you on delivery, but legal and beneficial ownership will remain with Red Rat until all sums owed to us, in respect of those products and all other products and services supplied by us, are paid in full. While property in the products remains with us, we have the irrevocable right to enter your premises where the goods are located and take possession of and remove the goods. Until ownership passes, you hold the products as bailee for Red Rat.

Changes to Terms and Conditions
We reserve the right to change these Terms at any time by notifying users of the existence of revised terms and conditions through the website. By continuing to access the website, you agree to be bound by the amended terms and conditions.

Waiver
If at any time we do not enforce any of these Terms or grant you time or other indulgence, we will not be construed as having waived that term or our rights to later enforce that or any other term.

Severability
If any portion of these Terms is deemed to be invalid, illegal or unenforceable the remaining provisions shall remain in full force and effect.

Governing Law
These Terms are governed by New Zealand law and you agree to submit to the exclusive jurisdiction of the New Zealand Courts. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
